TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your use of https://blacklightning-games.com and any content, games, and memberships offered there (the “Service”), operated by Black Lightning Inc. (“we”, “us”). By creating an account or purchasing a membership you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & age requirement

The Service contains material intended for adults. You must be at least 18 years old (or the age of majority where you live, if higher) to create an account or purchase a membership. All characters depicted are adults aged 18 or over. By using the Service you represent that you meet this requirement.

2. Accounts

You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it current. Do not share your account. Notify us at Blacklightninggames@protonmail.com if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms.

3. Memberships and billing

• Memberships are recurring subscriptions billed monthly in advance, at the price shown at checkout, until cancelled.
• Payment is processed by our payment provider. We do not receive or store your full card details.
• You authorise us and our payment provider to charge your selected payment method each billing cycle until you cancel.
• Prices may change; we will give notice before a change affects your renewal, and you may cancel before it takes effect.
• If a payment fails, access to paid content may be suspended or downgraded.

4. Cancellation

You may cancel at any time from your account page or through your payment provider. Cancellation stops future billing. You keep access for the remainder of the period you have already paid for, after which your account reverts to the free access level. Cancelling does not entitle you to a refund of the current or past periods — see the Refund Policy.

5. Licence and permitted use

Subject to these Terms and an active membership where required, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and download our content for your own private, non-commercial use. This licence does not transfer ownership.

You must not:

• copy, share, re-upload, resell, sublicense, or publicly distribute any content, in whole or in part;
• share your account or downloads with others, or make content available on any file-sharing, torrent, or similar service;
• circumvent, disable, or interfere with any access control, security, or tiering feature;
• use the Service unlawfully, or to harass, abuse, or harm anyone;
• scrape, crawl, or bulk-download the Service by automated means;
• reverse engineer, decompile, or attempt to derive source code, except where such restriction is prohibited by law.

Content downloaded during an active membership remains subject to this licence. If your account is terminated for breach of these Terms, your licence ends and you must stop using and delete the content.

6. Intellectual property

All content on the Service — including games, artwork, characters, text, and software — is owned by Black Lightning Inc. or its licensors and is protected by copyright and other laws. Except for the limited licence above, no rights are granted to you.

7. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Content, release schedules, and tier benefits may change or be withdrawn. We may modify or discontinue any part of the Service at any time.

8. Termination

We may suspend or terminate your access immediately, without refund, if you breach these Terms — in particular the licence restrictions in section 5. You may stop using the Service at any time.

9. Disclaimers

The Service and all content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, Black Lightning Inc. will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including your statutory consumer rights.

11. Indemnity

You agree to indemnify and hold harmless Black Lightning Inc. from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the Service.

12. Changes to these Terms

We may update these Terms from time to time. The “last updated” date above will change, and material changes will be notified on the Service. Continued use after a change means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. The courts of the Commonwealth of Virginia, United States will have exclusive jurisdiction, except where mandatory local consumer law gives you the right to bring a claim elsewhere.
